	신명기 19:15-21:23 모세는 증언의 중요성을 강조하여, 거짓 증언을 하는 자는 가차없이 처벌할 것을 명했다. 이스라엘이 가나안 본토 이외의 지역에서 전쟁을 수행할 때는 먼저 적군에게 평화를 청하여 조공을 요구하고 이를 거부할 경우 진멸시키라고 명했으며, 가해자를 모르는 살인 사건이 발생했을 경우의 속죄 규례와 장자 상속권의 보호 그리고 불효자의 징계를 명령했다.

	증인에 관한 규례(19:15-19:21)

어떤 나쁜 짓이든 어떤 잘못이든, 한 사람의 증언만으로는 증언이 성립되지 않는다. 어떤 잘못을 저질렀든지 두세 사람의 증언이 있어야 고소할 수 있다.

남에게 죄를 뒤집어씌우려고 해로운 증언을 하는 자가 나타날 경우에는

소송 중인 두 당사자는 야훼께로 나와 사제들과 그 때에 일보는 재판관들에게 재판을 받아야 한다.

재판관들은 잘 조사해 보고 그 증인이 동족에게 거짓 증언을 한 것이 드러나면

그가 그 동족에게 하려고 마음 먹었던 대로 그에게 갚아주어야 한다. 그리하여 이런 나쁜 짓을 너희 가운데서 송두리째 뿌리뽑아야 한다.

One witness shall not rise up against a man for any iniquity, or for any sin, in any sin that he sinneth: at the mouth of two witnesses, or at the mouth of three witnesses, shall the matter be established.

If a false witness rise up against any man to testify against him that which is wrong;

Then both the men, between whom the controversy is, shall stand before the LORD, before the priests and the judges, which shall be in those days;

And the judges shall make diligent inquisition: and, behold, if the witness be a false witness, and hath testified falsely against his brother;

Then shall ye do unto him, as he had thought to have done unto his brother: so shalt thou put the evil away from among you.

그리하면 다른 사람들이 이 말을 듣고 두려워하여 이런 나쁜 짓을 하는 자가 너희 가운데서 다시는 생기지 않을 것이다.

그런 자는 애처롭게 여기지 마라. 목숨은 목숨으로, 눈은 눈으로, 이는 이로, 손은 손으로, 발은 발로 갚아라.

And those which remain shall hear, and fear, and shall henceforth commit no more any such evil among you.

And thine eye shall not pity; but life shall go for life, eye for eye, tooth for tooth, hand for hand, foot for foot.

	전쟁시 유의 사항(20:1-20:20)

원수를 치러 싸움터에 나갔다가 적군이 너보다 많은 말과 병거를 몰고 나타나더라도 두려워하지 마라. 너희를 이집트 땅에서 올라오게 해주신 너희 하느님 야훼께서 너희 편에 서주신다.

싸움이 어우러지기 전에 사제는 나서서 군인들에게

이렇게 말하여라. '너, 이스라엘은 들어라. 오늘 너희는 원수를 치러 싸움터로 나간다. 겁내지 마라. 두려워하지 마라. 도망치지 마라. 원수를 앞에 두고 떨지 마라.

너희 하느님 야훼께서 너희와 함께 진격하시어 너희의 원수를 쳐주시고 너희에게 승리를 안겨주실 것이다.'

다음으로 장교들은 군인들에게 이렇게 말하여라. '너희 가운데 새 집을 짓고 그 집을 아직 하느님께 봉헌하지 못한 사람이 있느냐? 그런 사람은 집으로 돌아가거라. 싸움터에 나갔다가 죽어, 남이 그 집을 봉헌하게 할 수야 있겠느냐?

When thou goest out to battle against thine enemies, and seest horses, and chariots, and a people more than thou, be not afraid of them: for the LORD thy God is with thee, which brought thee up out of the land of Egypt.

And it shall be, when ye are come nigh unto the battle, that the priest shall approach and speak unto the people,

And shall say unto them, Hear, O Israel, ye approach this day unto battle against your enemies: let not your hearts faint, fear not, and do not tremble, neither be ye terrified because of them;

For the LORD your God is he that goeth with you, to fight for you against your enemies, to save you.

And the officers shall speak unto the people, saying, What man is there that hath built a new house, and hath not dedicated it? let him go and return to his house, lest he die in the battle, and another man dedicate it.

포도원을 새로 가꾸어놓고 아직 맛도 보지 못한 사람이 있느냐? 그런 사람은 집으로 돌아가거라. 싸움터에 나갔다가 죽어, 남이 그 맛을 보게 할 수야 있겠느냐?

약혼만 해놓고 아직 결혼하지 못한 사람이 있느냐? 그런 사람은 집으로 돌아가거라. 싸움터에 나갔다가 죽어, 남이 그 여자와 결혼하게 할 수야 있겠느냐?'

장교들은 또 이렇게 군인들에게 일러주어라. '두려워 겁나는 사람이 있느냐? 그런 사람도 집으로 돌아가거라. 그런 사람이 있으면 전우의 사기만 떨어진다.'

장교들이 군인들에게 이렇게 말하고 나면 지휘관들을 그들 앞에 배치하여 지휘하게 하여라.

어떤 성에 접근하여 치고자 할 때에는 먼저 화평을 맺자고 외쳐라.

And what man is he that hath planted a vineyard, and hath not yet eaten of it? let him also go and return unto his house, lest he die in the battle, and another man eat of it.

And what man is there that hath betrothed a wife, and hath not taken her? let him go and return unto his house, lest he die in the battle, and another man take her.

And the officers shall speak further unto the people, and they shall say, What man is there that is fearful and fainthearted? let him go and return unto his house, lest his brethren's heart faint as well as his heart.

And it shall be, when the officers have made an end of speaking unto the people that they shall make captains of the armies to lead the people.

When thou comest nigh unto a city to fight against it, then proclaim peace unto it.

만일 그들이 너희와 화평을 맺기로 하고 성문을 열거든 너희는 안에 있는 백성을 모두 노무자로 삼아 부려라.

만일 그들이 너희와 화평을 맺을 생각이 없어서 싸움을 걸거든 너희는 그 성을 포위 공격하여라.

너희 하느님 야훼께서 그 성을 너희 손에 부치실 터이니, 거기에 있는 남자를 모두 칼로 쳐죽여라.

그러나 여자들과 아이들과 가축들과 그 밖에 그 성 안에 있는 다른 모든 것은 전리품으로 차지하여도 된다. 너희 하느님 야훼께서 너희 원수들에게서 빼앗아주시는 전리품을 너희는 마음대로 쓸 수가 있다.

여기에 있는 민족들의 성읍이 아니고 아주 먼데 있는 성읍들에는 모두 그렇게 해야 한다.

And it shall be, if it make thee answer of peace, and open unto thee, then it shall be, that all the people that is found therein shall be tributaries unto thee, and they shall serve thee.

And if it will make no peace with thee, but will make war against thee, then thou shalt besiege it:

And when the LORD thy God hath delivered it into thine hands, thou shalt smite every male thereof with the edge of the sword:

But the women, and the little ones, and the cattle, and all that is in the city, even all the spoil thereof, shalt thou take unto thyself; and thou shalt eat the spoil of thine enemies, which the LORD thy God hath given thee.

Thus shalt thou do unto all the cities which are very far off from thee, which are not of the cities of these nations.

그러나 너희 하느님 야훼께 유산으로 받은 이 민족들의 성읍들에서는 숨쉬는 것을 하나도 살려두지 마라.

그러니 헷족, 아모리족, 가나안족, 브리즈족, 히위족, 여부스족은 너희 하느님 야훼께서 명령하신 대로 전멸시켜야 한다.

살려두었다가는 그들이 자기 신들에게 해올리는 발칙한 일을 너희에게 가르쳐주어 너희가 너희 하느님 야훼께 죄를 짓게 될 것이다.

한 성을 함락시키려고 포위 공격하는 데 오랜 세월이 걸리더라도, 거기에 있는 나무를 도끼로 마구 찍어내지는 마라. 나무에 여는 것을 따먹어야 할 터인데 찍어내면 되겠느냐? 들에 서 있는 나무가 사람처럼 너희를 피하여 성 안으로 들어갈 리 없지 않느냐?

너희는 어떤 나무가 과일을 맺지 않는 나무인지 알 것이다. 그런 나무는 찍어버려도 된다. 너희는 그런 나무로 성을 공략하는 기구를 만들고 너희에게 항거하는 성읍을 기어이 함락시켜야 한다.

But of the cities of these people, which the LORD thy God doth give thee for an inheritance, thou shalt save alive nothing that breatheth:

But thou shalt utterly destroy them; namely, the Hittites, and the Amorites, the Canaanites, and the Perizzites, the Hivites, and the Jebusites; as the LORD thy God hath commanded thee:

That they teach you not to do after all their abominations, which they have done unto their gods; so should ye sin against the LORD your God.

When thou shalt besiege a city a long time, in making war against it to take it, thou shalt not destroy the trees thereof by forcing an axe against them: for thou mayest eat of them, and thou shalt not cut them down (for the tree of the field is man's life) to employ them in the siege:

Only the trees which thou knowest that they be not trees for meat, thou shalt destroy and cut them down; and thou shalt build bulwarks against the city that maketh war with thee, until it be subdued.

	살인과 가정 문제(21:1-21:23)

너희 하느님 야훼께서 너희에게 주시어 차지하게 하신 땅에서 누구에게 살해되었는지 알 수 없는 사람의 시체가 발견될 경우에는

너희를 대표하는 장로들과 재판관들이 나가서 그 시체가 있는 곳에서 주변 성읍들에 이르는 거리를 재어라.

그리하여 그 시체에서 가장 가까운 성읍이 어느 성읍이든, 그 성읍의 장로들이 아직 멍에를 메고 일한 적이 없는 어린 암송아지를 끌어와

물이 늘 흐르는 골짜기로 끌고 내려가서, 보습을 대본 적이 없는 곳을 찾아 거기 물가에서 그 암송아지 목을 찍어라.

그러면 그 때 레위의 후손 사제들이 나설 것이다. 그들은 너희 하느님 야훼께 뽑혀 당신을 섬기고 야훼의 이름을 불러 축복하는 직책을 맡은 사람들이요, 모든 소송 사건과 폭행 사건을 판결하는 사람들이다.

If one be found slain in the land which the LORD thy God giveth thee to possess it, lying in the field, and it be not known who hath slain him:

Then thy elders and thy judges shall come forth, and they shall measure unto the cities which are round about him that is slain:

And it shall be, that the city which is next unto the slain man, even the elders of that city shall take an heifer, which hath not been wrought with, and which hath not drawn in the yoke;

And the elders of that city shall bring down the heifer unto a rough valley, which is neither eared nor sown, and shall strike off the heifer's neck there in the valley:

And the priests the sons of Levi shall come near; for them the LORD thy God hath chosen to minister unto him, and to bless in the name of the LORD; and by their word shall every controversy and every stroke be tried:

그 시체에서 가장 가까운 성읍의 장로들은 모두 그 골짜기에서 목 찍힌 암송아지에 대고 손을 씻으며

이렇게 말하여라. '우리의 손은 이 사람의 피를 흘리지 않았습니다. 우리는 현장을 목격하지도 못했습니다.

야훼여, 주께서 구해 내신 주의 백성 이스라엘의 죄를 벗겨주소서. 주의 백성 이스라엘 가운데서 죄없는 피가 흐르지 않게 하소서.' 이렇게 하면 그들은 그 피의 책임을 벗게 된다.

이렇게 너희는 너희 가운데서, 죄없는 자의 피를 흘리는 일을 송두리째 뿌리뽑아야 한다. 야훼께서 보시기에 옳은 일을 해야 한다.

원수를 치러 싸움터에 나갔다가 너희 하느님 야훼께서 원수를 너희 손에 붙여 사람을 사로잡게 해주셨을 때,

And all the elders of that city, that are next unto the slain man, shall wash their hands over the heifer that is beheaded in the valley:

And they shall answer and say, Our hands have not shed this blood, neither have our eyes seen it.

Be merciful, O LORD, unto thy people Israel, whom thou hast redeemed, and lay not innocent blood unto thy people of Israel's charge. And the blood shall be forgiven them.

So shalt thou put away the guilt of innocent blood from among you, when thou shalt do that which is right in the sight of the LORD.

When thou goest forth to war against thine enemies, and the LORD thy God hath delivered them into thine hands, and thou hast taken them captive,

그 포로들 가운데서 마음에 드는 아리따운 여자가 있으면 그를 아내로 맞아도 좋다.

그럴 경우 너희는 그를 집 안으로 맞아들여라. 그러나 머리를 밀고 손톱을 깎고

잡혀올 때 입었던 옷을 벗게 하여라. 그리고 한 달 동안 집에 있으면서 자기 부모를 생각하고 곡하게 하여라. 그런 다음에라야 한자리에 들 수 있다. 이렇게 하여 너희는 그의 남편이 되고 그는 너희 아내가 되는 것이다.

만일 그 여자가 더 이상 너희 마음에 들지 않거든 원하는 대로 가게 하여라. 절대로 돈을 받고 팔지는 마라. 그 몸을 버려놓았으니, 마구 부려먹어서도 안 된다.

한 남자가 두 아내를 거느리는데 하나는 사랑을 받고 하나는 미움을 받는다고 하자. 그런데 사랑을 받는 아내와 미움을 받는 아내가 다 아들을 낳아주었지만, 맏아들이 미움받는 아내의 아들일 경우에

And seest among the captives a beautiful woman, and hast a desire unto her, that thou wouldest have her to thy wife;

Then thou shalt bring her home to thine house, and she shall shave her head, and pare her nails;

And she shall put the raiment of her captivity from off her, and shall remain in thine house, and bewail her father and her mother a full month: and after that thou shalt go in unto her, and be her husband, and she shall be thy wife.

And it shall be, if thou have no delight in her, then thou shalt let her go whither she will; but thou shalt not sell her at all for money, thou shalt not make merchandise of her, because thou hast humbled her.

If a man have two wives, one beloved, and another hated, and they have born him children, both the beloved and the hated; and if the firstborn son be hers that was hated:

유산을 아들들에게 상속시켜 주는 날, 미움받는 아내에게서 난 맏아들을 제쳐 놓고 사랑받는 아내의 아들을 맏아들로 삼을 수 없다.

미움받는 아내의 아들을 맏아들로 인정해 주고 자기에게 있는 모든 것을 나누어 그에게 두 몫을 주어야 한다. 그 아들이 자기의 정력에서 난 첫 소생이기 때문에 맏아들의 권리는 그에게 있는 것이다.

아버지의 말이나 어머니의 말을 전혀 듣지 않고 거역하기만 하여 애를 태우는 아들이 있는 경우, 아무리 타일러도 듣지 않거든

부모는 그 고장 성문께, 성읍의 장로들이 있는 곳으로 그를 데리고 가서

그 성읍의 장로들에게 호소하여라. '이 녀석은 우리 아들인데 거역하기만 하고 애만 타게 합니다. 우리의 말을 전혀 듣지 않습니다. 방탕한데다가 술만 마십니다.'

Then it shall be, when he maketh his sons to inherit that which he hath, that he may not make the son of the beloved firstborn before the son of the hated, which is indeed the firstborn:

But he shall acknowledge the son of the hated for the firstborn, by giving him a double portion of all that he hath: for he is the beginning of his strength; the right of the firstborn is his.

If a man have a stubborn and rebellious son, which will not obey the voice of his father, or the voice of his mother, and that, when they have chastened him, will not hearken unto them:

Then shall his father and his mother lay hold on him, and bring him out unto the elders of his city, and unto the gate of his place;

And they shall say unto the elders of his city, This our son is stubborn and rebellious, he will not obey our voice; he is a glutton, and a drunkard.

그러면 온 시민은 그를 돌로 쳐죽일 것이다. 이런 나쁜 일은 너희 가운데서 송두리째 뿌리뽑아야 한다. 온 이스라엘이 이 말을 듣고 두려워하게 될 것이다.

죽을 죄를 지은 사람을 처형하고는 나무에 달아 효시할 경우가 있다.

이렇게 나무에 달린 시체는 하느님께 저주를 받은 것이니, 그 시체를 나무에 단 채 밤을 보내지 말고 그 날로 묻어라. 그렇게 두어서 너희 하느님 야훼께 유산으로 받은 너희 땅을 더럽히면 안 된다.

And all the men of his city shall stone him with stones, that he die: so shalt thou put evil away from among you; and all Israel shall hear, and fear.

And if a man have committed a sin worthy of death, and he be to be put to death, and thou hang him on a tree:

His body shall not remain all night upon the tree, but thou shalt in any wise bury him that day; (for he that is hanged is accursed of God;) that thy land be not defiled, which the LORD thy God giveth thee for an inheritance.
