	신명기 19:15-21:23 모세는 증언의 중요성을 강조하여, 거짓 증언을 하는 자는 가차없이 처벌할 것을 명했다. 이스라엘이 가나안 본토 이외의 지역에서 전쟁을 수행할 때는 먼저 적군에게 평화를 청하여 조공을 요구하고 이를 거부할 경우 진멸시키라고 명했으며, 가해자를 모르는 살인 사건이 발생했을 경우의 속죄 규례와 장자 상속권의 보호 그리고 불효자의 징계를 명령했다.

	증인에 관한 규례(19:15-19:21)

One witness shall not rise up against a man for any iniquity, or for any sin, in any sin that he sinneth: at the mouth of two witnesses, or at the mouth of three witnesses, shall the matter be established.

If a false witness rise up against any man to testify against him that which is wrong;

Then both the men, between whom the controversy is, shall stand before the LORD, before the priests and the judges, which shall be in those days;

And the judges shall make diligent inquisition: and, behold, if the witness be a false witness, and hath testified falsely against his brother;

Then shall ye do unto him, as he had thought to have done unto his brother: so shalt thou put the evil away from among you.

"어떤 잘못이나 어떤 범죄라도, 한 사람의 증언만으로는 판정할 수 없습니다. 두세 사람의 증언이 있어야만 그 일을 확정할 수 있습니다.

남에게 죄를 뒤집어 씌우려는 나쁜 증인이 나타나면,

소송을 하는 양쪽은 주님 앞에 나아와, 그 당시의 제사장들과 재판관 앞에 서서 재판을 받아야 합니다.

재판관들은 자세히 조사한 뒤에, 그 증인이 그 이웃에게 거짓 증언을 한 것이 판명되거든,

그 증인이 그 이웃을 해치려고 마음 먹었던 대로 그 이웃에게 갚아 주어야 합니다. 그래서 당신들 가운데서 그런 악의 뿌리를 뽑아야 합니다.

And those which remain shall hear, and fear, and shall henceforth commit no more any such evil among you.

And thine eye shall not pity; but life shall go for life, eye for eye, tooth for tooth, hand for hand, foot for foot.

그러면 남은 사람들이 이 말을 듣고 두려워하여서, 이런 악한 일을 하는 사람이 당신들 가운데서 다시는 생기지 않을 것입니다.

당신들은 이런 일에 동정을 베풀어서는 안 됩니다. 목숨에는 목숨으로, 눈에는 눈으로, 이에는 이로, 손에는 손으로, 발에는 발로 갚으십시오."

	전쟁시 유의 사항(20:1-20:20)

When thou goest out to battle against thine enemies, and seest horses, and chariots, and a people more than thou, be not afraid of them: for the LORD thy God is with thee, which brought thee up out of the land of Egypt.

And it shall be, when ye are come nigh unto the battle, that the priest shall approach and speak unto the people,

And shall say unto them, Hear, O Israel, ye approach this day unto battle against your enemies: let not your hearts faint, fear not, and do not tremble, neither be ye terrified because of them;

For the LORD your God is he that goeth with you, to fight for you against your enemies, to save you.

And the officers shall speak unto the people, saying, What man is there that hath built a new house, and hath not dedicated it? let him go and return to his house, lest he die in the battle, and another man dedicate it.

"당신들이 적군과 싸우려고 나가서, 당신들보다 많은 적군이 말과 병거를 타고 오는 것을 보더라도, 그들을 두려워하지 마십시오. 이집트 땅에서 당신들을 인도하여 주신 주 당신들의 하나님이 당신들과 함께 계십니다.

당신들이 싸움터에 나가기 전에 제사장을 불러서, 군인들에게 격려의 말을 하게 하여야 합니다.

제사장은 군인들을 다음과 같이 격려하십시오. '이스라엘아, 들어라. 오늘 너희가 너희의 대적과 싸우러 나갈 때에, 마음에 겁내지 말며, 무서워하지 말며, 당황하지 말며, 그들 앞에서 떨지 말아라.

주 너희의 하나님은 너희와 함께 싸움터에 나가서, 너희의 대적을 치시고, 너희에게 승리를 주시는 분이시다.'"

"그 다음에, 장교들은 군인들에게 다음과 같이 지시하십시오. '너희 가운데 집을 짓고 준공식을 하지 못한 사람이 있으면, 누구든지 집으로 돌아가거라. 그가 전사함으로써 다른 사람이 준공식을 하는 일이 없도록 하여라.

And what man is he that hath planted a vineyard, and hath not yet eaten of it? let him also go and return unto his house, lest he die in the battle, and another man eat of it.

And what man is there that hath betrothed a wife, and hath not taken her? let him go and return unto his house, lest he die in the battle, and another man take her.

And the officers shall speak further unto the people, and they shall say, What man is there that is fearful and fainthearted? let him go and return unto his house, lest his brethren's heart faint as well as his heart.

And it shall be, when the officers have made an end of speaking unto the people that they shall make captains of the armies to lead the people.

When thou comest nigh unto a city to fight against it, then proclaim peace unto it.

또 포도원을 만들어 놓고 아직 그 열매를 맛보지 못한 사람이 있으면, 그런 사람도 누구든지 집으로 돌아가거라. 그가 전사함으로써 다른 사람이 그 열매를 맛보는 일이 없도록 하여라.

또 너희 가운데 여자와 약혼하고 아직 결혼하지 못한 사람이 있으면, 그런 사람도 집으로 돌아가거라. 그가 전사함으로써 다른 사람이 그 여자와 결혼하는 일이 없도록 하여라.'

장교들은 군인들에게 또 이렇게 지시하십시오. '전쟁이 두려워서 겁이 나면, 누구든지 집으로 돌아가거라. 그런 사람이 있으면 다른 형제의 사기만 떨어진다.'

장교들이 군인들에게 이런 지시를 다 끝마치면, 군인들 위에 지휘자를 임명하십시오.

당신들이 어떤 성읍에 가까이 가서 공격할 때에는, 먼저 그 성읍에 평화를 청하십시오.

And it shall be, if it make thee answer of peace, and open unto thee, then it shall be, that all the people that is found therein shall be tributaries unto thee, and they shall serve thee.

And if it will make no peace with thee, but will make war against thee, then thou shalt besiege it:

And when the LORD thy God hath delivered it into thine hands, thou shalt smite every male thereof with the edge of the sword:

But the women, and the little ones, and the cattle, and all that is in the city, even all the spoil thereof, shalt thou take unto thyself; and thou shalt eat the spoil of thine enemies, which the LORD thy God hath given thee.

Thus shalt thou do unto all the cities which are very far off from thee, which are not of the cities of these nations.

만일 그 성읍 백성이 평화 제의를 받아들이고, 당신들에게 성문을 열거든, 그 성 안에 있는 백성을 당신들의 노비로 삼고, 당신들을 섬기게 하십시오.

그들이 당신들의 평화 제의를 거부하고 싸우러 나오거든, 당신들은 그 성읍을 포위하고 공격하십시오.

주 당신들의 하나님이 그 성읍을 당신들의 손에 넘겨 주셨으니, 거기에 있는 남자는 모두 칼로 쳐서 죽이십시오.

여자들과 아이들과 가축과 그 밖에 성 안에 있는 모든 것은 전리품으로 가져도 됩니다. 당신들이 당신들의 대적에게서 빼앗은 것은 주 당신들의 하나님이 당신들에게 주신 것이니, 당신들의 마음대로 먹고 쓸 수가 있습니다.

당신들의 주변 민족들의 성읍에 딸리지 아니한, 당신들로부터 먼 거리에 있는 성읍들에도 이렇게 하여야 합니다.

But of the cities of these people, which the LORD thy God doth give thee for an inheritance, thou shalt save alive nothing that breatheth:

But thou shalt utterly destroy them; namely, the Hittites, and the Amorites, the Canaanites, and the Perizzites, the Hivites, and the Jebusites; as the LORD thy God hath commanded thee:

That they teach you not to do after all their abominations, which they have done unto their gods; so should ye sin against the LORD your God.

When thou shalt besiege a city a long time, in making war against it to take it, thou shalt not destroy the trees thereof by forcing an axe against them: for thou mayest eat of them, and thou shalt not cut them down (for the tree of the field is man's life) to employ them in the siege:

Only the trees which thou knowest that they be not trees for meat, thou shalt destroy and cut them down; and thou shalt build bulwarks against the city that maketh war with thee, until it be subdued.

그러나 주 당신들의 하나님이 당신들에게 유산으로 주신 땅에 있는 성읍을 점령하였을 때에는, 숨쉬는 것은 하나도 살려 두면 안 됩니다.

곧 헷 사람과 아모리 사람과 가나안 사람과 브리스 사람과 히위 사람과 여부스 사람은 주 당신들의 하나님이 당신들에게 명하신 대로 전멸시켜야 합니다.

그렇지 않으면, 그들이 그들의 신을 섬기는 온갖 역겨운 일을 당신들에게 가르쳐서, 당신들이 주 당신들의 하나님께 죄를 짓게 할 것입니다.

당신들이 한 성읍을 점령하려고 둘러싸서 공격하는데 오랜 기간이 걸리더라도, 거기에 있는 과일나무를 도끼로 마구 찍어서는 안 됩니다. 과일은 따서 먹도록 하십시오. 그러나 나무를 찍어 버리지는 마십시오. 들에 있는 나무가 원수라도 된단 말입니까? 어찌 그 나무들을 포위하겠습니까?

다만, 먹을 열매를 맺지 못하는 나무는 당신들이 알고 있으니, 그런 나무는 찍어도 좋습니다. 당신들은 그런 나무를 찍어서, 당신들과 싸우는 성읍을 점령할 때까지, 성읍을 포위하는 데 필요한 장비를 만들어서 쓰도록 하십시오."

	살인과 가정 문제(21:1-21:23)

If one be found slain in the land which the LORD thy God giveth thee to possess it, lying in the field, and it be not known who hath slain him:

Then thy elders and thy judges shall come forth, and they shall measure unto the cities which are round about him that is slain:

And it shall be, that the city which is next unto the slain man, even the elders of that city shall take an heifer, which hath not been wrought with, and which hath not drawn in the yoke;

And the elders of that city shall bring down the heifer unto a rough valley, which is neither eared nor sown, and shall strike off the heifer's neck there in the valley:

And the priests the sons of Levi shall come near; for them the LORD thy God hath chosen to minister unto him, and to bless in the name of the LORD; and by their word shall every controversy and every stroke be tried:

"주 당신들의 하나님이 당신들에게 주셔서 차지하게 하시는 땅에서, 누구에게 살해되었는지 알 수 없는 사람의 주검이 들에서 발견될 때에는,

장로들과 재판관들이 현장에 나가서, 그 주검 주위에 있는 성읍들에 이르는 거리를 재십시오.

그 주검에서 가장 가까운 성읍이 있을 터이니, 그 성읍의 장로들은 아직 멍에를 메고 일한 적이 없는 암송아지 한 마리를 끌고 와서,

물이 늘 흐르는 골짜기, 갈지도 심지도 않은 골짜기로 그 암송아지를 끌고 내려가, 물가에서 암송아지의 목을 꺾어서 죽이십시오.

그 때에 레위 자손 제사장들도 그 곳으로 나와야 합니다. 그들은 주 당신들의 하나님이 선택하셔서, 주님을 섬기며 주님의 이름으로 축복하는 직책을 맡은 사람으로서, 모든 소송과 분쟁을 판결할 것입니다.

And all the elders of that city, that are next unto the slain man, shall wash their hands over the heifer that is beheaded in the valley:

And they shall answer and say, Our hands have not shed this blood, neither have our eyes seen it.

Be merciful, O LORD, unto thy people Israel, whom thou hast redeemed, and lay not innocent blood unto thy people of Israel's charge. And the blood shall be forgiven them.

So shalt thou put away the guilt of innocent blood from among you, when thou shalt do that which is right in the sight of the LORD.

When thou goest forth to war against thine enemies, and the LORD thy God hath delivered them into thine hands, and thou hast taken them captive,

이 때에 피살자의 주검이 발견된 곳에서 가장 가까운 성읍의 장로들은 물가에서, 목이 꺾인 암송아지 위에 냇물로 손을 씻고,

아래와 같이 증언하십시오. '우리는 이 사람을 죽이지 않았고, 이 사람이 살해되는 현장을 목격하지도 못하였습니다.

주님, 주님께서 속량하여 주신 주님의 백성 이스라엘의 죄를 사하여 주시고, 주님의 백성 이스라엘 사람에게 무죄한 사람을 죽인 살인죄를 지우지 말아 주십시오.' 이렇게 하면, 그들은 살인의 책임을 벗게 됩니다.

이렇게 해서 당신들은 당신들에게 지워진 살인의 책임을 벗으십시오. 이렇게 하는 것은 주님께서 보시기에 옳은 일입니다."

"당신들이 적군과 싸울 때에, 주 당신들의 하나님이 적군을 당신들의 손에 넘겨 주셔서 당신들이 그들을 사로잡았을 때에,

And seest among the captives a beautiful woman, and hast a desire unto her, that thou wouldest have her to thy wife;

Then thou shalt bring her home to thine house, and she shall shave her head, and pare her nails;

And she shall put the raiment of her captivity from off her, and shall remain in thine house, and bewail her father and her mother a full month: and after that thou shalt go in unto her, and be her husband, and she shall be thy wife.

And it shall be, if thou have no delight in her, then thou shalt let her go whither she will; but thou shalt not sell her at all for money, thou shalt not make merchandise of her, because thou hast humbled her.

If a man have two wives, one beloved, and another hated, and they have born him children, both the beloved and the hated; and if the firstborn son be hers that was hated:

그 포로들 가운데서 마음에 드는 아리따운 여자가 있으면 그를 아내로 삼아도 됩니다.

그 여자를 아내로 삼을 남자는 그 여자를 자기 집으로 데리고 가서, 그 머리를 밀고 손톱을 깎고,

잡혀 올 때에 입었던 포로의 옷을 벗게 하여야 합니다. 그리고 한 달 동안 집 안에 있으면서, 자기의 부모를 생각하면서 애곡하게 하여야 합니다. 그런 다음에라야 동침할 수 있습니다. 이렇게 하여 부부가 됩니다.

그 뒤에 그 여자가 더 이상 남편의 마음에 들지 않으면 그 여자의 마음대로 가게 하여야 하며, 돈을 받고 팔아서는 안 됩니다. 남편이 그 여자를 욕보였으므로, 종으로 팔아서는 안 됩니다."

"어떤 사람에게 두 아내가 있는데, 한 사람은 사랑을 받고 다른 한 사람은 사랑을 받지 못하다가, 사랑받는 아내와 사랑받지 못하는 아내가 다 같이 아들을 낳았는데, 맏아들이 사랑받지 못하는 아내의 아들일 경우에,

Then it shall be, when he maketh his sons to inherit that which he hath, that he may not make the son of the beloved firstborn before the son of the hated, which is indeed the firstborn:

But he shall acknowledge the son of the hated for the firstborn, by giving him a double portion of all that he hath: for he is the beginning of his strength; the right of the firstborn is his.

If a man have a stubborn and rebellious son, which will not obey the voice of his father, or the voice of his mother, and that, when they have chastened him, will not hearken unto them:

Then shall his father and his mother lay hold on him, and bring him out unto the elders of his city, and unto the gate of his place;

And they shall say unto the elders of his city, This our son is stubborn and rebellious, he will not obey our voice; he is a glutton, and a drunkard.

남편이 자기의 재산을 아들에게 물려 주는 날에, 사랑받지 못하는 아내에게서 난 맏아들을 제쳐놓고 사랑받는 아내의 아들에게 장자권을 줄 수는 없습니다.

반드시 사랑받지 못하는 아내의 아들을 맏아들로 인정하고, 자기의 모든 재산에서 두 몫을 그에게 주어야 합니다. 그 아들은 정력의 첫 열매이기 때문에, 맏아들의 권리가 그에게 있는 것입니다."

"어떤 사람에게, 아버지의 말이나 어머니의 말을 전혀 듣지 않고, 반항만 하며, 고집이 세어서 아무리 타일러도 듣지 않는 아들이 있거든,

그 부모는 그 아들을 붙잡아, 그 성읍의 장로들이 있는 성문 위의 회관으로 데리고 가서,

그 성읍의 장로들에게 '우리의 아들이 반항만 하고, 고집이 세어서 우리의 말을 전혀 듣지 않습니다. 방탕한 데다가 술만 마십니다' 하고 호소하십시오.

And all the men of his city shall stone him with stones, that he die: so shalt thou put evil away from among you; and all Israel shall hear, and fear.

And if a man have committed a sin worthy of death, and he be to be put to death, and thou hang him on a tree:

His body shall not remain all night upon the tree, but thou shalt in any wise bury him that day; (for he that is hanged is accursed of God;) that thy land be not defiled, which the LORD thy God giveth thee for an inheritance.

그러면 그 성읍의 모든 사람이 그를 돌로 쳐서 죽일 것입니다. 이렇게 하여서 당신들 가운데서 악을 뿌리 뽑아야 합니다. 그래야만 온 이스라엘이 그 일을 듣고 두려워할 것입니다."

"죽을 죄를 지어서 처형된 사람의 주검은 나무에 매달아 두어야 합니다.

그러나 당신들은 그 주검을 나무에 매달아 둔 채로 밤을 지내지 말고, 그 날로 묻으십시오. 나무에 달린 사람은 하나님께 저주를 받은 사람이기 때문입니다. 당신들은 주 당신들의 하나님이 당신들에게 유산으로 준 땅을 더럽혀서는 안 됩니다.
